EK Consulting Limited (‘The Operator’), a private limited liability company registered under the laws of Malta with company number C 63605, having its registered address situated at 10 Mediterranean Court, Tigne Seafront, Sliema SLM 3012, Malta, knows that You care about how information about You is used and shared, and is committed to protecting Your personal data and information and comply with the applicable data protection laws. The Operator strives for its’ services to be safe and enjoyable for everyone, and this Policy aims to help You understand what information the Operator might collect about You and how the Operator makes use of such information.

By visiting http://www.batonbaton.com/ (the ‘Website’), including any of its sub-domains and links thereon, (and by accessing or using any Service offered by the Operator through the Website, or which is available for download through third party applications), You are accepting and consenting to the practices that are adopted by the Operator, and which are described in this Policy.

The Operator complies with the Data Protection Act, Chapter 440 of the laws of Malta, (the ‘Applicable Law’), which laws transpose the relevant European Union directives on the subject. Any personal information that is provided to, or gathered by the Operator is controlled by the Operator, thereby acting as the data controller in terms of the Applicable Law.

The Operator is responsible for the collection and processing of personal data from the Website and ensures that Your personal data is processed fairly, lawfully, in accordance with good practice and collected only for specific purposes which are known and accepted by You when You make use of the Website. In this regard, the Operator is a registered Data Controller in line with the Applicable Law.

Information Gathered

The information gathered by the Operator helps the Operator personalise and continually improve the experience on the Website provided to You. The Operator uses the information to improve the Website infrastructure that is offered, and to prevent or detect fraud or abuses.

The Operator may collect, and You hereby provide Your explicit consent to such collection, information on the pages of the Operator’s Website that You visit, including, but not limited to, IP addresses, geolocation data, the type of browser You use, details of any links which direct You to the Website and the times You access the Operator’s Website. If the Operator decides to merge with another company in the future, through processes such as re-organisation and/ or merger and/ or sale and/ or acquisition and/ or liquidation, and/ or through any other process, Your personal data may be transferred along with the Operator or its part, or it may be sold as part of the Operator.

Indemnity

This Policy represents the entire agreement between You and the Operator in relation to its subject matter and supersedes and voids all prior agreements between such parties relating to such subject matter.

Severability

In the event that any of these terms, conditions or provisions shall be determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision shall to that extent be severed from the remaining terms, conditions and provisions which shall continue to be valid to the fullest extent permitted by law.

Law and Forum

The parties hereby agree that this Policy, together with any other documents with which this Policy forms an integral part, shall be governed by and construed in accordance with the laws of Malta and shall be subject to the jurisdiction of the Courts of Malta.
